Terms of Service

1. Acceptance of Terms

By accessing or using this website, you agree to these Terms of Service. This page covers the terms for using the Scorpion Media (ABN 72 463 144 788) website only — it is not the contract that governs paid client engagements (see “Client Engagements” below).

2. About This Website

This website provides general information about Scorpion Media’s marketing consulting services: who we work with, how our process works, and our current pricing. Nothing on this site is a binding offer, and published prices and service descriptions may be updated at any time.

3. Client Engagements

If you engage Scorpion Media for consulting services, that engagement is governed by a separate, signed Client Onboarding Agreement between you and Scorpion Media. Where anything on this website conflicts with your signed agreement, the signed agreement controls.

4. No Guarantees of Marketing Outcomes

Scorpion Media provides analysis, diagnostics, and strategic recommendations. Marketing performance depends on many factors outside our control, including your market, your execution, and platform changes. Nothing on this website is a guarantee of any specific marketing result, revenue outcome, or return on ad spend.

5. Intellectual Property

The content on this website — including text, graphics, and the Scorpion Media name and logo — is owned by Scorpion Media or its licensors and is protected by applicable intellectual property laws. You may not reproduce or repurpose it without our written permission.

6. Limitation of Liability

To the maximum extent permitted by Australian law, Scorpion Media is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, this website, or from any decisions made based on information published here.

7. Governing Law

These terms are governed by the laws of Victoria, Australia, and any disputes relating to this website are subject to the exclusive jurisdiction of the courts of Victoria.

Privacy Policy

This policy explains how Scorpion Media handles personal information in connection with this website, in line with the Australian Privacy Act 1988 (Cth).

1. Information We Collect

We collect only what we need to respond to you and run our business, namely:

  • Name, email, phone number, and business details you submit through our contact or booking forms.
  • Scheduling information you provide when booking a discovery call.
  • Basic technical information (such as IP address and browser type) that our hosting provider logs automatically for security and performance.

2. How We Use Your Information

We use the information we collect to:

  • Respond to enquiries and schedule discovery calls.
  • Deliver and administer our consulting services to clients.
  • Maintain the security and proper functioning of this website.

We do not sell your personal information to anyone, ever.

3. Third Parties We Use

We use Calendly to power scheduling on our Book a Call page. When you book a call, the details you provide are handled by Calendly under its own privacy policy in addition to this one. We do not currently run third-party analytics tools on this site; if that changes, we’ll update this policy to name the tool and what it collects.

4. Storage and Security

We store the information we collect with reputable service providers and take reasonable steps to protect it from misuse, loss, or unauthorised access. No online system is completely secure, and we can’t guarantee absolute security of information transmitted to us.

5. Your Rights

You can ask us to access, correct, or delete the personal information we hold about you at any time by emailing info@scorpionmedia.com.au. We’ll respond to reasonable requests within a reasonable timeframe.
